ARTICLE 2 - SUBJECT MATTER

The subject of this contract is the sale and delivery of the product(s) ordered electronically by the BUYER on the SELLER's website, carpetdocia.com, including the qualifications and sales price specified below, in accordance with the provisions of the Consumer Protection Law No. 4077 and the Regulation on Distance Contracts, and to determine the rights and obligations of the parties.

ARTICLE 4 - GENERAL TERMS AND CONDITIONS

4.1- The BUYER acknowledges having read and confirmed electronically all preliminary information regarding the basic features, sales price, payment method, and delivery details of the product(s) listed on carpetdocia.com.
4.2- The product(s) subject to the contract shall be delivered to the BUYER or the person/institution indicated at the address within the time frame disclosed on the website, provided it does not exceed the legal maximum of 3 business days, depending on the delivery location.
4.3- If the product is to be delivered to a third party other than the BUYER, the SELLER shall not be held responsible if the recipient refuses delivery.
4.4- The SELLER is responsible for delivering the product(s) subject to the contract in sound condition, complete, and as specified in the order, including warranty documents and user manuals, if applicable.
4.5- Delivery of the product(s) is conditional upon the signed copy of this contract reaching the SELLER and full payment being made by the BUYER. If payment is not completed or is cancelled in bank records, the SELLER is no longer obligated to deliver the product.
4.6- If, after delivery, the BUYER's credit card is used unlawfully or fraudulently by unauthorized persons without the BUYER’s fault, and the relevant financial institution does not pay the SELLER, the BUYER must return the delivered product to the SELLER within 3 days. In this case, shipping costs shall be borne by the BUYER.
4.7- If delivery cannot be made on time due to force majeure or extraordinary circumstances such as weather conditions or disruption of transportation, the SELLER must inform the BUYER. The BUYER may choose to cancel the order, replace the product with a similar one, or postpone delivery until the issue is resolved. If the order is canceled, the amount paid shall be refunded to the BUYER in full within 21 days.
4.8- Products with or without a warranty certificate may be sent to the SELLER for repair if found to be faulty or defective. In such cases, shipping costs shall be covered by the SELLER.

ARTICLE 5 - RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within 14 days of delivery of the product(s) to themselves or to a designated third party. To exercise this right, the BUYER must notify the SELLER via e-mail, phone, or fax within this period, and the product must not be used as per the provisions in Article 6.

Upon exercising the right of withdrawal, the product must be returned to the SELLER along with a copy of the delivery receipt and the original invoice. The refund shall be processed within 21 days of the return documents being received. If the original invoice is not provided, VAT and other legal obligations cannot be refunded.

The return shipping cost in case of withdrawal shall be borne by the BUYER.
After a product is exchanged at the request of the BUYER, the right of withdrawal or a second exchange is no longer available. The product is not eligible for further return or replacement.

ARTICLE 6 - PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to products that are not suitable for return due to their nature, such as:

  • Disposable products

  • Software and programs that can be copied

  • Perishable goods or items with an expiration date

For the products below, withdrawal is only accepted if the packaging is unopened and the product is unused:

  • Portable computers (non-returnable after the original OS is installed)

  • All types of software and programs

  • DVDs, VCDs, CDs, cassettes

  • Computer and stationery consumables (toner, cartridges, ribbons, etc.)

  • All types of cosmetics

  • Mobile top-up orders

ARTICLE 7 - COMPETENT COURT

For the implementation of this contract, Consumer Arbitration Committees up to the value announced by the Ministry of Trade and Consumer Courts at the BUYER's or SELLER's location shall have jurisdiction.

If the order is confirmed, the BUYER is deemed to have accepted all terms and conditions of this agreement.
